But then he showed me the designs, plain cotton tees made from recycled plastic bottles, bags, straws, etc. They are stitched with surprising detail; each tag stamped with the brand name \u201cReweave .\u201d<\/p>\n\n\n\n<p>I watched him go from weekend seller to full-time founder, and he had gathered a customer base in a matter of months. Six months ago, he called me with big news: he had filed a trademark for Reweave in order to protect his brand and be seen more nationally.&nbsp;<\/p>\n\n\n\n<p>But last week, Manohar messaged me, it read: &#8220;CRISIS. TRADEMARK OBJECTION. WHAT DO I DO?&#8221;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"what-is-a-trademark-objection-anyway\">What is a trademark objection anyway?<\/h2>\n\n\n\n<p>Before that, what is a trademark?<\/p>\n\n\n\n<p>According to section<a href=\"https:\/\/www.indiacode.nic.in\/show-data?actid=AC_CEN_11_60_00004_199947_1517807323972&amp;orderno=2\" target=\"_blank\" rel=\"noreferrer noopener\"> <mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-secondary-color\">2(1)(zb)<\/mark><\/a>:<\/p>\n\n\n\n<p style=\"margin-left:0;padding-left:var(--wp--preset--spacing--60)\"><em>\u201cTrade mark means a mark capable of being represented graphically and which is capable of distinguishing the goods or services of one person from those of others and may include shape of goods, their packaging and combination of colours\u201d<\/em><\/p>\n\n\n\n<p>If you have ever filed a trademark in India and gotten an objection, then you probably know the feeling. Everything seems fine for a while. Then out of nowhere, you get a formal-looking PDF from the Trade Marks Registry. It is called an Examination Report, and tucked inside is something called a Trademark Objection.<\/p>\n\n\n\n<p>Now, let us get one thing clear. An objection is not a rejection.<\/p>\n\n\n\n<p>It just means the Trademark Examiner has found an issue with your application. It could be something as simple as your mark sounding too generic. Or it could be because it looks too similar to an already registered trademark. At this stage, they are only looking for an explanation from your end.&nbsp;<\/p>\n\n\n\n<p>These objections usually fall under two sections of the <a href=\"https:\/\/www.indiacode.nic.in\/bitstream\/123456789\/15427\/1\/the_trade_marks_act%2C_1999.pdf\" target=\"_blank\" rel=\"noopener\">T<\/a>rade Marks Act, 1999:<\/p>\n\n\n\n<p>Section <a href=\"https:\/\/www.indiacode.nic.in\/show-data?abv=null&amp;statehandle=null&amp;actid=AC_CEN_11_60_00004_199947_1517807323972&amp;orderno=9&amp;orgactid=AC_CEN_11_60_00004_199947_1517807323972\" target=\"_blank\" rel=\"noreferrer noopener\"><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-secondary-color\">9<\/mark><\/a>, which deals with absolute grounds like the mark being too descriptive or lacking distinctiveness. It says:&nbsp;<\/p>\n\n\n\n<p style=\"padding-left:var(--wp--preset--spacing--60)\"><em>(a) which are devoid of any distinctive character, that is to say, not capable of distinguishing the goods or services of one person from those of another person;<\/em><\/p>\n\n\n\n<p style=\"padding-left:var(--wp--preset--spacing--60)\"><em>(b) which consist exclusively of marks or indications which may serve in trade to designate the kind, quality, quantity, intended purpose, values, geographical origin or the time of production of the goods or rendering of the service or other characteristics of the goods or service;<\/em><\/p>\n\n\n\n<p style=\"padding-left:var(--wp--preset--spacing--60)\"><em>(c) which consist exclusively of marks or indications which have become customary in the current language or in the bona fide and established practices of the trade, shall not be registered:<\/em><\/p>\n\n\n\n<p style=\"padding-left:var(--wp--preset--spacing--60)\"><em>Provided that a trade mark shall not be refused registration if before the date of application for registration it has acquired a distinctive character as a result of the use made of it or is a well-known trade mark.<\/em><\/p>\n\n\n\n<p style=\"padding-left:var(--wp--preset--spacing--60)\"><em>(2) A mark shall not be registered as a trade mark if&#8211;<\/em><\/p>\n\n\n\n<p style=\"padding-left:var(--wp--preset--spacing--60)\"><em>(a) it is of such nature as to deceive the public or cause confusion;<\/em><\/p>\n\n\n\n<p style=\"padding-left:var(--wp--preset--spacing--60)\"><em>(b) it contains or comprises of any matter likely to hurt the religious susceptibilities of any class or section of the citizens of India;<\/em><\/p>\n\n\n\n<p style=\"padding-left:var(--wp--preset--spacing--60)\"><em>(c) it comprises or contains scandalous or obscene matter;<\/em><\/p>\n\n\n\n<p style=\"padding-left:var(--wp--preset--spacing--60)\"><em>(d) its use is prohibited under the Emblems and Names (Prevention of Improper Use) Act, 1950 (12 of 1950).<\/em><\/p>\n\n\n\n<p style=\"padding-left:var(--wp--preset--spacing--60)\"><em>(3) A mark shall not be registered as a trade mark if it consists exclusively of&#8211;<\/em><\/p>\n\n\n\n<p style=\"padding-left:var(--wp--preset--spacing--60)\"><em>(a) the shape of goods which results from the nature of the goods themselves; or<\/em><\/p>\n\n\n\n<p style=\"padding-left:var(--wp--preset--spacing--60)\"><em>(b) the shape of goods which is necessary to obtain a technical result; or<\/em><\/p>\n\n\n\n<p style=\"padding-left:var(--wp--preset--spacing--60)\"><em>(c) the shape which gives substantial value to the goods.<\/em><\/p>\n\n\n\n<p style=\"padding-left:0\">Section<mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-secondary-color\"> <\/mark><a href=\"https:\/\/www.indiacode.nic.in\/show-data?abv=null&amp;statehandle=null&amp;actid=AC_CEN_11_60_00004_199947_1517807323972&amp;orderno=11&amp;orgactid=AC_CEN_11_60_00004_199947_1517807323972\" target=\"_blank\" rel=\"noreferrer noopener\"><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-secondary-color\">11<\/mark><\/a> covers relative grounds, like your mark being deceptively similar to someone else\u2019s. It says:\u00a0<\/p>\n\n\n\n<p style=\"padding-left:var(--wp--preset--spacing--60)\"><em>(1) Save as provided in section 12, a trade mark shall not be registered if, because of&#8211;<\/em><\/p>\n\n\n\n<p style=\"padding-left:var(--wp--preset--spacing--60)\"><em>(a) its identity with an earlier trade mark and similarity of goods or services covered by the trade mark; or<\/em><\/p>\n\n\n\n<p style=\"padding-left:var(--wp--preset--spacing--60)\"><em>(b) its similarity to an earlier trade mark and the identity or similarity of the goods or services covered by the trade mark, there exists a likelihood of confusion on the part of the public, which includes the likelihood of association with the earlier trade mark.<\/em><\/p>\n\n\n\n<p style=\"padding-left:var(--wp--preset--spacing--60)\"><em>(2) A trade mark which&#8211;<\/em><\/p>\n\n\n\n<p style=\"padding-left:var(--wp--preset--spacing--60)\"><em>(a) is identical with or similar to an earlier trade mark; and<\/em><\/p>\n\n\n\n<p style=\"padding-left:var(--wp--preset--spacing--60)\"><em>(b) is to be registered for goods or services which are not similar to those for which the earlier trade mark is registered in the name of a different proprietor, shall not be registered if or to the extent the earlier trade mark is a well-known trade mark in India and the use of the later mark without due cause would take unfair advantage of or be detrimental to the distinctive character or repute of the earlier trade mark.<\/em><\/p>\n\n\n\n<p style=\"padding-left:var(--wp--preset--spacing--60)\"><em>(3) A trade mark shall not be registered if, or to the extent that, its use in India is liable to be prevented&#8211;<\/em><\/p>\n\n\n\n<p style=\"padding-left:var(--wp--preset--spacing--60)\"><em>(a) by virtue of any law in particular the law of passing off protecting an unregistered trade mark used in the course of trade; or<\/em><\/p>\n\n\n\n<p style=\"padding-left:var(--wp--preset--spacing--60)\"><em>(b) by virtue of law of copyright.<\/em><\/p>\n\n\n\n<p style=\"padding-left:var(--wp--preset--spacing--60)\"><em>(4) Nothing in this section shall prevent the registration of a trade mark where the proprietor of the earlier trade mark or other earlier right consents to the registration, and in such case the Registrar may register the mark under special circumstances under section 12.<\/em><\/p>\n\n\n\n<p>In Manohar\u2019s case, the objection was under section <a href=\"https:\/\/www.indiacode.nic.in\/show-data?abv=null&amp;statehandle=null&amp;actid=AC_CEN_11_60_00004_199947_1517807323972&amp;orderno=9&amp;orgactid=AC_CEN_11_60_00004_199947_1517807323972\" target=\"_blank\" rel=\"noopener\">9<\/a>. The Examiner said \u201cReweave \u201d was descriptive and not capable of distinguishing his goods from others.<\/p>\n\n\n\n<p>Manohar was confused. \u201cBut I made it up,\u201d he said. \u201cI have got customers, an Instagram following, and even eco-influencers wearing my stuff.\u201d<\/p>\n\n\n\n<p>He had a point. But that alone was not going to convince the Registry. We had to respond, and we had to do it fast.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"manohar-reads-the-objection-report\">Manohar reads the objection report<\/h2>\n\n\n\n<p>The objection report was about four pages long. Manohar sent it to me with a message that just said, \u201cWhat does this even mean?\u201d<\/p>\n\n\n\n<p>So, I opened it. The language was classic legalese\u2014<\/p>\n\n\n\n<p>\u201cThe applied-for mark appears to be devoid of any distinctive character and is descriptive in nature under the meaning of section<mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-secondary-color\"> <\/mark><a href=\"https:\/\/www.indiacode.nic.in\/show-data?abv=null&amp;statehandle=null&amp;actid=AC_CEN_11_60_00004_199947_1517807323972&amp;orderno=9&amp;orgactid=AC_CEN_11_60_00004_199947_1517807323972\" target=\"_blank\" rel=\"noreferrer noopener\"><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-secondary-color\">9(1)(b)<\/mark><\/a>\u2026\u201d<\/p>\n\n\n\n<p>Here is what it meant: the Examiner thought \u201cReweave \u201d was too descriptive. According to them, it is just something anew.&nbsp;<\/p>\n\n\n\n<p>\u201cBut that is the whole point!\u201d Manohar said. \u201cIt is a material that is reworked. And that is literally my brand.\u201d<\/p>\n\n\n\n<p>I explained that this was not the end. Not even close. We just had to respond properly and show them why \u201cReweave \u201d deserved that \u00ae symbol.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"how-to-respond-to-a-trademark-objection-step-by-step\">How to respond to a trademark objection: Step by step<\/h2>\n\n\n\n<h4 class=\"wp-block-heading\" id=\"1-understand-the-grounds-of-objection\">1. Understand the grounds of objection<\/h4>\n\n\n\n<p>This is where things get technical. But bear with me because it matters.<\/p>\n\n\n\n<p>When you receive an objection, the first thing you do is figure out why you got it in the first place. That means identifying whether the objection is under section <a href=\"https:\/\/www.indiacode.nic.in\/show-data?abv=null&amp;statehandle=null&amp;actid=AC_CEN_11_60_00004_199947_1517807323972&amp;orderno=9&amp;orgactid=AC_CEN_11_60_00004_199947_1517807323972\" target=\"_blank\" rel=\"noreferrer noopener\"><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-secondary-color\">9<\/mark><\/a> or section <a href=\"https:\/\/www.indiacode.nic.in\/show-data?abv=null&amp;statehandle=null&amp;actid=AC_CEN_11_60_00004_199947_1517807323972&amp;orderno=11&amp;orgactid=AC_CEN_11_60_00004_199947_1517807323972\" target=\"_blank\" rel=\"noreferrer noopener\"><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-secondary-color\">11<\/mark><\/a>.<\/p>\n\n\n\n<p>It can either be about marks that are too descriptive, generic, or non-distinctive. Words like \u201cFresh Milk\u201d for a dairy company will trigger this. And the other one would mean that your mark is clashing with someone else\u2019s. Either it looks too similar, sounds too similar, or is likely to confuse consumers.<\/p>\n\n\n\n<p>Once you know what the issue is, you can start building your case.<\/p>\n\n\n\n<p>In Manohar\u2019s case, we were clearly dealing with a section <a href=\"https:\/\/www.indiacode.nic.in\/show-data?abv=null&amp;statehandle=null&amp;actid=AC_CEN_11_60_00004_199947_1517807323972&amp;orderno=9&amp;orgactid=AC_CEN_11_60_00004_199947_1517807323972\" target=\"_blank\" rel=\"noreferrer noopener\"><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-secondary-color\">9<\/mark><\/a> issue. So our goal was to show that \u201cReweave\u201d had acquired distinctiveness and that people <em>already<\/em> recognised it as a brand, not just a concept.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\" id=\"2-gather-evidence-of-use\">2. Gather evidence of use&nbsp;<\/h4>\n\n\n\n<p>This is where many applicants fall short. They try to argue purely on legal points. But in trademark law, proof matters.&nbsp;<\/p>\n\n\n\n<p>I told Manohar to send me everything he had, such as:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Screenshots of his Instagram page,<\/li>\n\n\n\n<li>Photos of the t-shirts with the Reweave&nbsp; tag,<\/li>\n\n\n\n<li>Invoices from early buyers,<\/li>\n\n\n\n<li>Email orders,<\/li>\n\n\n\n<li>Customer reviews,<\/li>\n\n\n\n<li>Press coverage, if any.<\/li>\n<\/ul>\n\n\n\n<p>Anything that showed that people were seeing \u201cReweave \u201d as a brand and associating it with him was useful.<\/p>\n\n\n\n<p>This kind of evidence is called acquired distinctiveness. Even if your mark is weak to begin with, if you have used it long enough and consistently, and people associate it with your goods, you can defend it.<\/p>\n\n\n\n<p>Manohar had enough material to build a decent case.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\" id=\"3-draft-the-reply-to-the-examination-report\">3. Draft the reply to the examination report<\/h4>\n\n\n\n<p>Now came the actual writing. This is where a lawyer earns their <em>chai<\/em>. The reply has to be clear, confident, and backed by law and facts. It is usually submitted through Form <a href=\"https:\/\/ipindia.gov.in\/writereaddata\/Portal\/Images\/pdf\/FORM-TM-M.pdf\" target=\"_blank\" rel=\"noreferrer noopener\"><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-secondary-color\">TM-M<\/mark><\/a>, along with the reply document and annexures, which will be your evidence.&nbsp;<\/p>\n\n\n\n<figure class=\"wp-block-image\"><img decoding=\"async\" src=\"https:\/\/lh7-rt.googleusercontent.com\/docsz\/AD_4nXfk_iMTKP2Vt0DoI0nO1i0NFGHS9nOd8apE68H1cA1qm1F5fFPD9es8UI0MPEN3zrHXrlyjKWpj_--KpnERjYq9FB_ZgxAEY5Xd_b2i58yhRzC_RUeTYggRnqzPKhOMrOqam4QX?key=qMS8MvtTeNYbHeM9qrqE_whd\" alt=\"\"\/><\/figure>\n\n\n\n<p>The structure of the reply usually follows this format:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>A brief introduction of the applicant and the trademark.<\/li>\n\n\n\n<li>A point-wise rebuttal of each objection raised.<\/li>\n\n\n\n<li>Legal arguments with references to case law.<\/li>\n\n\n\n<li>Details of prior use and distinctiveness.<\/li>\n\n\n\n<li>A prayer to accept the mark for advertisement in the Journal.<\/li>\n<\/ul>\n\n\n\n<p>Also, you have to mention the class of goods as well. Manohar\u2019s will fall under class 25.&nbsp;<\/p>\n\n\n\n<figure class=\"wp-block-image\"><img decoding=\"async\" src=\"https:\/\/lh7-rt.googleusercontent.com\/docsz\/AD_4nXem61Xo-L8hxtIOT42cQIMbME4skpVFH2L2raeIbLtAuj-PYyrZRUjeg8xBYFYzoxndAbBsrPxRBpejldvkib6Mq_E9m6cjUAp1sxzeXKSXaZx_QrsR0jLQox9AvT62YRaJ9p6nhA?key=qMS8MvtTeNYbHeM9qrqE_whd\" alt=\"\"\/><\/figure>\n\n\n\n<figure class=\"wp-block-image\"><img decoding=\"async\" src=\"https:\/\/lh7-rt.googleusercontent.com\/docsz\/AD_4nXfBeZTTwUxgafasiXV9k6GU-Wep7mN24sPWbEChh36PBOyKq-AgO7nXPdMvyvppomtmavgT-Egyou7W1a_c6ZT83kjddujDTIZcKFDU6wj007wA-31CPvZeT_8wKeoGonLIXmSR9g?key=qMS8MvtTeNYbHeM9qrqE_whd\" alt=\"\"\/><\/figure>\n\n\n\n<p>I\u2019ll show you a sample of Manohar\u2019s reply.&nbsp;<\/p>\n\n\n\n<p>But before that, a quick note on timelines, you only get 30 days from the date of the objection report to file this reply. If you miss it, your application is treated as abandoned. So you really need to act quickly.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\" id=\"manohars-reply\">Manohar\u2019s reply<\/h4>\n\n\n\n<p><em><mark style=\"background-color:rgba(0, 0, 0, 0);color:#fa0808\" class=\"has-inline-color\">The first thing you need to is write the subject and address it to the respected registry. Manohar started the business in business.&nbsp;<\/mark><\/em><\/p>\n\n\n\n<p>Subject: Reply to Examination Report \u2013 Application No. 0987654 for the mark \u201cReweave \u201d in Class 25<\/p>\n\n\n\n<p>To: The Registrar of Trade Marks, Trade Marks Registry, Mumbai<\/p>\n\n\n\n<p><em><mark style=\"background-color:rgba(0, 0, 0, 0);color:#ee0303\" class=\"has-inline-color\">Here you need to give a brief introduction of your client and their trademark.<\/mark><\/em><\/p>\n\n\n\n<p>Dear Sir\/Madam,<\/p>\n\n\n\n<p>The applicant is Manohar Dev. The applicant is a small-town hero turning plastic bottles into stylish T-shirts under his brand \u201cReweave .\u201d Since January 2023, he has been building a name for sustainable fashion in Mumbai, only to hit a speed bump with your examination report for Application No. 0987654. The objection under section <a href=\"https:\/\/www.indiacode.nic.in\/show-data?abv=null&amp;statehandle=null&amp;actid=AC_CEN_11_60_00004_199947_1517807323972&amp;orderno=9&amp;orgactid=AC_CEN_11_60_00004_199947_1517807323972\" target=\"_blank\" rel=\"noreferrer noopener\">9(1)(b)<\/a> claims \u201cReweave\u201d is descriptive. With respect, we disagree, and here is why the applicant\u2019s mark deserves to shine.<\/p>\n\n\n\n<p><em><mark style=\"background-color:rgba(0, 0, 0, 0);color:#f40606\" class=\"has-inline-color\">Here, you need to give a point-wise rebuttal of each objection raised. Explain why the mark is distinctive and not descriptive. You can explain that it is a coined term and also talk about how it acquired distinctiveness. Although, coin term will not automatically grant you acceptance, it can be one of the pointers.&nbsp;<\/mark><\/em><\/p>\n\n\n\n<p>1. The mark \u201cReweave\u201d is distinctive, not descriptive<\/p>\n\n\n\n<p>Section <a href=\"https:\/\/www.indiacode.nic.in\/show-data?abv=null&amp;statehandle=null&amp;actid=AC_CEN_11_60_00004_199947_1517807323972&amp;orderno=9&amp;orgactid=AC_CEN_11_60_00004_199947_1517807323972\" target=\"_blank\" rel=\"noreferrer noopener\">9(1)(b)<\/a> bars marks that directly describe the goods. \u201cReweave\u201d does not do that. It is a coined term. Reweave, essentially meaning that something is reworked. They create a unique vibe, not a literal description of clothing. In&nbsp;<em><strong>Marico Limited v. Agro Tech Foods Limited,<\/strong><\/em><strong> (2010)<\/strong>, suggestive marks can be registered with evidence of market recognition. \u2018Reweave\u2019 aligns with this, reflecting a unique eco-lifestyle, not clothing itself. \u201cReweave\u201d suggests a lifestyle which is green, bold, conscious and not just T-shirts.<\/p>\n\n\n\n<p>The applicant has a customer base. Customers do not buy the brand because of the clothing only, they buy it because of the unique style and created with a bigger purpose, which is recycling plastic. That is a commercial impression, not a dictionary definition.<\/p>\n\n\n\n<p>2. Acquired distinctiveness through use<\/p>\n\n\n\n<p>Even if the Registry finds \u201cReweave\u201d suggestive, it has earned its stripes. Instagram handle @ReweaveThreads has 13,000 followers, with 5,000+ engagements on posts showcasing his recycled designs (Annexure B).<\/p>\n\n\n\n<p>More than 150 testimonials from buyers praising \u201cReweave\u201d as synonymous with eco-fashion (Annexure C).<\/p>\n\n\n\n<p>Features in eco-focused outlets like The Green Times blog (10,000 monthly readers) and a Mumbai radio segment (Annexure D) bolster \u2018Reweave\u2019s\u2019 niche recognition.&nbsp;<\/p>\n\n\n\n<p>Product tags and packaging scream \u201cReweave\u201d in bold green letters (Annexure E).<\/p>\n\n\n\n<p>This is not just a use; it is proof \u201cReweave\u201d means Applicant\u2019s brand, not generic clothing. As per <strong><em>Godfrey Phillips India Ltd. v. Girnar Food<\/em> (2004)<\/strong>, evidence of market recognition can overcome section <a href=\"https:\/\/www.indiacode.nic.in\/show-data?abv=null&amp;statehandle=null&amp;actid=AC_CEN_11_60_00004_199947_1517807323972&amp;orderno=9&amp;orgactid=AC_CEN_11_60_00004_199947_1517807323972\" target=\"_blank\" rel=\"noopener\">9<\/a> hurdles. This shows growing distinctiveness.&nbsp;<\/p>\n\n\n\n<p>3. Applicant built goodwill that is distinctly his.<\/p>\n\n\n\n<p><em><mark style=\"background-color:rgba(0, 0, 0, 0);color:#f30b0b\" class=\"has-inline-color\">Finally, you need to add the prayer wherein you should request them to accept your client\u2019s brand.&nbsp;<\/mark><\/em><\/p>\n\n\n\n<p>4.
